The European Commission refers to individuals who confessed to and repented of violent crimes as "arbitrarily detained"

The European Commission`s [EC] 2026 Enlargement Report described individuals detained in connection with violent protests in Georgia as "arbitrarily detained", including those who admitted to committing offences and expressed remorse.

The report refers to individuals arrested during violent demonstrations outside Parliament and the Presidential Palace in 2024 and 2025. It also notes that President of Georgia pardoned several persons after they admitted their guilt.

"In August, the President pardoned several individuals, following their admission of guilt, who had been arbitrarily detained in connection with the 2024-2025 protests. However, many more remain in prison", - reads the report.

It does not mention that plea agreements were reached with many of those detained after they admitted to committing offences, resulting in dozens of releases.

The EC calls for the release of all those who remain in detention. However, its assessment also covers individuals serving prison sentences for throwing Molotov cocktails at law enforcement officers.
