In relation to small parties, we have taken into account international legal practice, which tells us that if a party does not exercise substantial influence over political process, it cannot be a threat to the constitutional order. Such a statement the Prime Minister of Georgia made in the interview with Imedi LIVE.

"We relied, first of all, on legal practice. The Constitutional Court of Georgia, of course, is guided by international practice. We did not want to file a lawsuit against parties that could not achieve the appropriate result. Such a practice has been established in Germany, and the practice of the Strasbourg Court also follows the same logic.

For example, a lawsuit was filed regarding the banning of the "National Democratic" party, and the German Constitutional Court did not even accept the lawsuit for consideration because this political party did not have the real resources to overcome the barrier and it was, by its nature, a very small, influential party. When a party does not have a significant influence on the real process, in this case, it does not pose a real threat to the constitutional order.

We took this practice into account. There are many related parties, probably 10-15 such parties, some are fictitious, some are 1-member parties, some are 2-member parties, the rest are small parties that do not even come close to the electoral threshold.

We took into account the legal practice that is established at the international level, which tells us that if a party does not have a significant influence on the political process, in this case, it cannot be a threat to the constitutional order and, as I have already told you, the German Constitutional Court, for example, does not even take it into consideration. There were 2 such cases involving a small party, and in neither case did the court accept the lawsuit in the proceedings", - said Irakli Kobakhidze.
