Interim Fact-Finding Commission investigating the facts of violation of property rights and torture and inhuman treatment in 2004-2012

The Interim Fact-Finding Commission on the Activities of the Regime, the Political Leaders of the Regime of 2003-2012 and the Activity of the Incumbent and Former Officials in the Political Unions since 2003 up to today questioned two persons - Valeri Shoshiashvili and Giuli Avalishvili.

As Shoshiashvili noted, his family has been engaged in business activities since 2005. In 2006, Irakli Kirkitadze, a high-ranking official of the Financial Police, requested that V. Shoshiashvili remit 1500 USD per container entering customs. He explained that this payment should be redirected to Vano Merabishvili. Failure to comply with this request would result in Kirkitadze`s arrest and severe consequences for Shoshiashvili`s family.

In 2008, shortly before the Parliamentary Elections, he was summoned to the Financial Police for the second time. The purpose of this summons was to request that he donate 100,000 GEL to the National Movement. To facilitate this donation, he was forced to obtain a loan from a bank. According to him, in 2010, Irakli Kirkitadze tasked him to buy the air time on Rustavi2 TV valued at 50,000 GEL for the "Christian-Democratic Movement". As he noted, in the same year, I. Kirkitadze also requested to register the limited liability company.

“Upon fulfilling his request and registering the business, the company experienced a decline. Irakli Kirkitadze was appointed to the managing board and became a Director, while I maintained my ownership position. I was a "captive" of the National Movement, with no means of dissent, as any opposition could result in severe and intractable problems".

According to him, in 9 months, I. Kirkitadze left the business. As the reporter said, since 2010, he has been regularly summoned to the Prosecution Office. Specifically, the investigator, Beka Basilaia has initiated requests for the concession of the family business to a particular individual.

"I spent the most arduous twelve hours of my life in the Prosecution Office. Beka Basilaia and the prosecutor, Zaza Maludze, engaged in a conversation in my presence, deliberating over the potential punishments for me. The walls were adorned with numerous photographs of my family members, including my minor children, wife, and sister". According to his account, Beka Basilaia exhibited video footage depicting the torture of inmates as a means of exerting pressure on him.

As he mentioned, due to the fact that his property was under a mortgage, his payment method was modified. In a matter of months, B. Basilaia coerced him into purchasing the Gremi Culture House at the auction for 700,000 GEL instead of the initial stated amount of 100,000 GEL. As a result, he was required to secure a loan of 420,000 GEL from the Bank of Georgia. The bank-related issues were subsequently "solved" by B. Basilaia himself.

Later, B. Basilaia required of him to take 300,000 more GEL to the Prosecution Office, otherwise, he would be liquidated. According to the reporter, B. Basilaia summoned him to the Prosecution Office a few days after the October 1, 2012, Elections. He offered one million USD for his silence, which was declined. As presumed by V. Shoshiashvili, if he had accepted the bribe, he would have been immediately arrested.

As he had mentioned, in January 2013, he received a letter from the National Enforcement Bureau. The letter stipulated that the loan of 420,000 USD and the ongoing business loan were to be repaid to the Bank of Georgia. Failure to comply with this request would result in the sale of his property through an auction. This notice was the immediate cause of his stroke. In 2014, he was recognised as an aggrieved party by the Prosecution Office.

Giuli Avalishvili also provided her account about her brother, Giorgi Avalishvili, deceased in 2012.

According to her account, her brother was a bus driver during the rallies in May 2011, transporting the protesters. Notably, after the dispersal of the May 26 rally, he was arrested through provocation. As she noted, after her brother was transferred to the Gldani Prison, he appeared in hell - he sustained daily beatings, torture for several months, which resulted in kidney failure and his physical mutilation.

After one such act of torture, her brother was taken to the morgue for a certain period of time.

Chasing the desire to save him, G. Avalishvili started to knock on the doors of all respective agencies, including President Saakashvili, addressing him four times without any response, and the Public Defender, Giorgi Tugushi refused to accept this case. Consequently, due to the terminal kidney failure, her brother`s sentence was postponed in May 2012. However, he passed away on the third day after his release.

"I would like to address Saakashvili with a question: why did he commit murder against an innocent person? Why did he extinguish the peaceful existence of one Georgian family? Why did he establish a regime that employed torture?" - she implored.

As the Chair of the Commission, Tea Tsulukiani stated, this case, along with many other similar cases, will be reflected in the conclusion.

"We have received extensive information and numerous cases, and we anticipate much more. However, our mandate is insufficient due to Saakashvili`s detrimental impact on the country, bringing hell to the land. Nevertheless, the cases we have already investigated, all the reports, evidence pieces, and other relevant information are currently being scrutinised to establish a comprehensive conclusion. This conclusion will serve as a legal and political foundation for prohibiting these offenders from engaging in political activities forever" - she asserted.
