GCCA finds infringement of consumer rights by "Food Gallery Georgia"

The Georgian Competition and Consumer Agency has confirmed that LLC "Food Gallery Georgia" infringed the Law of Georgia on the Protection of Consumer Rights.

The examination of the case found that, in the event of service cancellation, the trader had delayed reimbursement of funds to consumers beyond a reasonable period.

Furthermore, an infringement was identified in respect of the provision of the contractually agreed service. In particular, the catering service conditions offered in advance and disclosed to consumers differed substantially from those actually provided. In the Agency`s assessment, conformity of service entails both adherence to the conditions offered in advance and the assurance of an adequate standard of service quality.

By its decision, the GCCA instructed LLC "Food Gallery Georgia", with a view to remedying the infringement, to restore consumers` infringed rights and to bring its trading policy into conformity with the requirements of the law within a period of one month.

Under the applicable legislation, failure to comply, or improper compliance, with the Agency`s decision within the prescribed time limit may result in a fine of up to 2% of the trader’s annual turnover for the preceding financial year. A repeated infringement within a period of 12 months shall result in the doubling of the fine imposed.
