The Tbilisi City Court fully accepted the evidence presented by the Prosecutor’s Office and sentenced the founders of Kinderli Georgia LLC to 10 years in prison each for abusing their official position and embezzling a large amount of funds by a group with prior agreement.
The evidence examined at the trial confirmed that the defendants established a company in Tbilisi, Kinderly Georgia LLC, which acts as an intermediary between biological parents and surrogate mothers. On behalf of the company, they concluded contracts with biological parents and undertook to find surrogate mothers and ensure the birth of a child through in vitro fertilization. In this way, the defendants embezzled large amounts of money from citizens of the Republic of China and, instead of covering the surrogate mothers' various expenses and the remuneration provided for in the contract, using their official position, collectively appropriated more than 2,060,006.5 GEL belonging to both potential parents and surrogate mothers.
The Tbilisi City Court found the defendants, one of them in absentia, fully guilty under Article 182, Part 2, Subparagraphs “a”, “d” and Part 3, Subparagraph “b” (misappropriation of a large amount of money by a group by prior agreement using official position) of the Criminal Code of Georgia.
